By accessing, browsing or otherwise using the Site, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and, where you engage us for paid Services, our Terms of Business. If you do not agree to these Terms, please stop using the Site immediately.

4.Permitted use of the Site

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Site for your personal or internal business use, on the condition that you comply with these Terms.

  • You own that material or have the right to share it with us for the purposes for which you have shared it;
  • It does not infringe the intellectual property, privacy or other rights of any third party;
  • It does not contain any unlawful, defamatory, obscene or otherwise objectionable content; and
  • It does not contain any virus or other harmful code.

You grant us a non-exclusive, royalty-free, worldwide, sub-licensable licence to use, copy, store and process that material for the purpose of evaluating your enquiry and, where we engage to deliver Services to you, performing those Services. Where you become a paying client, the licence and ownership of deliverables is governed by our Terms of Business.

9.Site availability

We aim to keep the Site available 24 hours a day, but we do not guarantee uninterrupted access. We may, at our sole discretion and without prior notice, suspend, withdraw, discontinue or change all or any part of the Site for operational, security or business reasons.

We may, at our sole discretion and without notice, suspend or terminate your access to the Site if we have reasonable grounds to believe that you have breached these Terms or that your conduct is harmful to us, our other users or any third party.

16.Force majeure

If any provision (or part of any provision) of these Terms is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these Terms shall not be affected.

17.2 No waiver

A failure or delay by us to exercise any right or remedy under these Terms is not a waiver of that right or remedy.

17.3 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time without notice.

17.4 Third-party rights

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.

17.5 Entire agreement

These Terms, together with our Privacy Policy and (where applicable) our Terms of Business, constitute the entire agreement between you and us in relation to your use of the Site and supersede any previous agreement or understanding.

18.Governing law and jurisdiction

These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. You and we both irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
